her &#8216;with his penis&#8217; in 2002, but he vehemently denied the allegations\u00a0\u00a0<\/strong><\/li>\n<\/ul>\n<p>Jamie Foxx\u00a0has been sued for an alleged sexual assault that happened\u00a0in 2015.\u00a0<\/p>\n<p><span>In a new lawsuit,\u00a0obtained by DailyMail.com<\/span><span>, the\u00a055-year-old Oscar winner was accused of placing &#8216;both hands&#8217; on a woman&#8217;s waist, before proceeding to move them &#8216;under her top.&#8217;<\/span><\/p>\n<p>The\u00a0plaintiff,\u00a0identified only as &#8216;Jane Doe,&#8217; claimed he &#8216;started rubbing her breasts&#8217; after he &#8216;pulled her by the arm to the back area of the rooftop&#8217;\u00a0at Catch NYC &amp; Roof.<\/p>\n<p>She alleges the incident occurred, around 1 a.m., a few hours after she and a friend were seated at a table away from him at the\u00a0celebrity hotspot.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/11\/23\/00\/78136779-0-image-a-60_1700699933430.jpg\" height=\"423\" width=\"634\"><\/p>\n<p>Nasty allegations:\u00a0Jamie Foxx has been sue for a sexual assault that allegedly happened in 2015 at Catch NYC &amp; Roof (seen in 2023)<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/11\/23\/01\/78137423-12782213-image-a-79_1700701672334.jpg\" height=\"196\" width=\"634\"><\/p>\n<p>Celebrity hotspot: The plaintiff claimed he &#8216;started rubbing her breasts&#8217; after he &#8216;pulled her by the arm to the back area of the rooftop&#8217; at Catch NYC &amp; Roof (the restaurant seen above)<\/p>\n<p>According to the lawsuit, &#8216;the plaintiff&#8217;s friend asked Foxx if he&#8217;d take a photo with her and the plaintiff&#8217; and he allegedly replied: &#8216;Sure, baby anything for you.&#8217;\u00a0<\/p>\n<p>She claims he &#8216;seemed intoxicated at the time&#8217; and told her that &#8216;she looked like Gabrielle Union.&#8217;\u00a0<\/p>\n<p>Additionally, the plaintiff claimed he told her: &#8216;Wow, you have that supermodel body&#8217; and that she smelled &#8216;so good.&#8217;\u00a0<\/p>\n<p>After he allegedly got physical with her, the plaintiff said she &#8216;attempted to step away and noticed a security guard and others who saw what had happened&#8217; but says they &#8216;chose to walk away.&#8217;\u00a0<\/p>\n<p>The plaintiff says things escalated quickly and alleges that he &#8216;slid his hand into her pants and put his fingers on and in her vagina and anus.&#8217;\u00a0<\/p>\n<p>Once her friend saw what allegedly occurred, the plaintiff said her pal rushed over and &#8216;Jamie stopped touching her.&#8217;\u00a0<\/p>\n<p>The plaintiff claims to have sought medical treatment and suffered pain as well as emotional distress &#8216;as a result of the &#8216;sexual assault, abuse, assault and battery.&#8217;\u00a0<\/p>\n<p>She is suing Foxx and Catch as well as its employees for compensation and punitive damages.\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/11\/23\/01\/78138425-12782213-image-a-84_1700702453443.jpg\" height=\"951\" width=\"634\"><\/p>\n<p>She alleges the incident occurred, around 1 a.m., a few hours after she and a friend were seated at a table away from him at the celebrity hotspot (seen in 2015)<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/11\/23\/01\/78139053-12782213-image-a-92_1700703958326.jpg\" height=\"821\" width=\"634\"><\/p>\n<p>According to the lawsuit, &#8216;the plaintiff&#8217;s friend asked Foxx if he&#8217;d take a photo with her and the plaintiff&#8217; and he allegedly replied: &#8216;Sure, baby anything for you&#8217;<\/p>\n<p>The suit is filed under New York&#8217;s Adult Survivors Act, which opened a one-year revival window to file sexual abuse claims that would otherwise be barred by the statute of limitations.\u00a0<\/p>\n<p>The deadline to file such claims ends on Thursday.\u00a0<\/p>\n<p>DailyMail.com has reached out to\u00a0Foxx&#8217;s representatives, but have not heard back at this time.<\/p>\n<p>At the time of the alleged incident, he was in a relationship with actress\u00a0Katie Holmes, who he split from after six years of dating in May 2019.<\/p>\n<p>He was previously accused of\u00a0sexual misconduct after a woman claimed he &#8216;slapped&#8217; her &#8216;with his penis&#8217; in 2002.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/11\/23\/01\/78138131-12782213-image-a-83_1700702103120.jpg\" height=\"793\" width=\"634\"><\/p>\n<p>At the time of the alleged incident, he was dating actress Katie Holmes, who he split from after six years together in May 2019 (seen together in 2019)<\/p>\n<p>In 2018, the Las Vegas police confirmed to People that a &#8216;female victim came to the LVMPD and alleged that a sexual assault occurred in the Las Vegas area in 2002&#8217; and Foxx was named &#8216;as the suspect.&#8217;\u00a0<\/p>\n<p>At the time, Foxx&#8217;s lawyer issued a statement to the outlet denying the claims.\u00a0<\/p>\n<p>&#8216;Jamie Foxx emphatically denies that this incident ever occurred, and he will be filing a report with the Las Vegas Police Department against the woman for filing a false police report against him,&#8217; Foxx&#8217;s attorney said. &#8216;The first time Mr. Foxx became aware of this woman&#8217;s absurd claims about an incident that supposedly occurred sixteen years ago was when TMZ contacted his representatives today about this story.&#8217;\u00a0<\/p>\n<p>The lawyer added, &#8216;The alleged incident was not reported to law enforcement in 2002, or at any other time in the last sixteen years until last Friday because the incident never happened. We consider it to be extraordinarily reckless for any publication to publish this bogus story.&#8217;\u00a0<\/p>\n<p>The allegations come seven months after he suffered an\u00a0unspecified medical emergency in April,\u00a0which left him hospitalized for months.<\/p>\n<p>In August, he revealed to his fans that he &#8216;is &#8216;finally starting to feel like&#8217; himself again after his health scare.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/11\/23\/01\/74693101-12782213-Healing_Last_week_he_revealed_to_his_fans_that_he_is_finally_sta-a-90_1700703885374.jpg\" height=\"634\" width=\"634\"><\/p>\n<p>Rough year:\u00a0The allegations come seven months after he suffered an unspecified medical emergency in April, which left him hospitalized for months<\/p>\n<p>While speaking to his 16.8 million Instagram followers, at the time, he opened up about going through &#8216;an unexpected dark journey.&#8217;<\/p>\n<p>Despite the challenges in his recovery, the performer said he &#8216;can see the light&#8217; and is &#8216;thankful to everyone that reached out and sent well wishes and prayers.&#8217;<\/p>\n<p>&#8216;I have a lot of people to thank\u2026 u just don\u2019t know how much it meant\u2026 I will be thanking all of you personally\u2026 and if you didn\u2019t know\u2026 GOD IS GOOD\u2026 all day every day,&#8217; he concluded.<\/p>\n<p>The update came less than a month after Foxx giving his first detailed update on how he has been doing since getting discharged from the hospital.<\/p>\n<p>Foxx informed fans that he is not &#8216;blind&#8217; or &#8216;paralyzed&#8217; in an emotional three-minute recording about his health.<\/p>\n<p>&#8216;I went through something I never thought I would go through. I know a lot of people [were] waiting or wanting to hear an update, but to be honest with you, I didn&#8217;t want you to see me like that man,&#8217; he admitted, with tears in his eyes.<\/p>\n<p>The actor, who returned to work last month to film a commercial in Las Vegas, continued: &#8216;I want you to see me laughing, having a good time, partying, cracking a joke, doing a movie, [or] a television show.&#8217;<\/p>\n<p>&#8216;I didn&#8217;t want you to see me with tubes running out of me and trying to figure out if I was going to make it through.&#8217;<\/p>\n<p>The father-of-one added that he went through &#8216;hell and back&#8217; to survive and has experienced some &#8216;potholes&#8217; on his &#8216;road to recovery.&#8217;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/11\/23\/01\/74693109-12782213-Foxx_informed_fans_that_he_is_not_blind_or_paralyzed_in_an_emoti-a-91_1700703910512.jpg\" height=\"984\" width=\"634\"><\/p>\n<p>Over the summer, Foxx informed fans that he is not &#8216;blind&#8217; or &#8216;paralyzed&#8217; in an emotional three-minute recording about his health<\/p>\n<p>The Beat Shazam host also praised his sister, Deondra Dixon, and daughter, Corinne, 29, for &#8216;saving&#8217; his life and keeping the details around his hospitalization private.<\/p>\n<p>&#8216;To them, to God, to a lot of great medical people, I&#8217;m able to leave you this video,&#8217; Foxx added. &#8216;I cannot tell you how great it feels to have your family kick in in such a way, and y&#8217;all know they kept it airtight, they didn&#8217;t let nothing out, they protected me, and that&#8217;s what I hope that everyone could have in moments like these.&#8217;<\/p>\n<p>He proceeded to show how his &#8216;eyes are working just fine&#8217; by moving them from side to side, before making it clear that he is &#8216;not paralyzed.&#8217;<\/p>\n<p>Speaking to fans directly, he said: &#8216;I just want to say I love everybody and I love all the love that I got.&#8217;<\/p>\n<p>The actor got choked up as he warned: &#8216;If you see me out from now on and every once in a while I just burst into tears, it\u2019s just because it\u2019s been tough, man. I was sick, man. But now I got my legs under me, so you\u2019re gonna see me out.&#8217;<\/p>\n<p>&#8216;Man, I know they talk about people crying on videos&#8230; but I&#8217;m not going to do a take two, it is what is is,&#8217; he mused. &#8216;Like I said, I want you to remember me for the jokes that I crack and the movies that I make \u2014 some of them good, some of them ain&#8217;t (I think I&#8217;ve got a good one out), and songs that I sing.&#8217;<\/p>\n<p>&#8216;I&#8217;m here on earth because of some great people. I&#8217;m here on Earth because of God, man,&#8217; the performer concluded. &#8216;I&#8217;m on way back.&#8217;<\/p>\n<p>Foxx captioned the video: &#8216;Thank u a billion to everybody\u2026 been a long road but all the prayers great people and God got me through.&#8217;<\/p>\n<p>In July, the star was reported to be in &#8216;amazing shape&#8217; as he resumed his work commitments, an insider told TMZ.<\/p>\n<p>Another source added to People: &#8216;Jamie was putting in really long days and was spot on.
